TRUST BENEFICIARY ENGAGEMENT SHEET

IF YOU ARE THE BENEFICIARY OF A TRUST BEING MANAGED BY LAGNIAPPE FIDUCIARY,
PLEASE BE ADVISED OF THE FOLLOWING POLICIES:

Disbursements: You can make requests by using the form on our website or by emailing info@lagniappefiduciary.com

  • Any requests for disbursements from the trust must be in writing. The Trustee has the duty to review the request and make a determination if the disbursement from the trust is allowed and if it is in the best interest of the beneficiary.
  • When making requests for reimbursements, advise the Trustee in advance of the requested purchase so that bids or estimates can be obtained; OR present the Trustee with a receipt showing payment*
    (*We cannot guarantee reimbursements for payments made without Trustees knowledge).
  • Any requested disbursement over $250 must be pre-approved. This means that you must make the request BEFORE buying the items or agreeing to make a purchase. Any purchases over $250.00 without pre-approval will not be reimbursed.
  • Disbursement requests are reviewed weekly; However, you must provide a written request along with any back up documentation such as receipts or invoices to the Trustee. If you are requesting a disbursement before a particular date, we must have the request at least 14 business days before the disbursement date requested.
  • Depending on the type and terms of the Trust Document and the size and nature of the request, the disbursement may or may not be approved. The Trustee has a duty to safeguard the trust assets and to make disbursements only as allowed by law and only in the best interest of the trust and the beneficiary.

Accountings: Trust accountings are filed annually. We do not file monthly accountings.

  • We will provide financial statements within 30 days of a request; However, we may charge the trust for the bookkeeper’s time, copy charges, or time of any staff required to provide the information.

Earnings: If the trust has sufficient earnings during the year, federal and state tax returns will be filed. The charges of the CPA and bookkeeper for this work will be paid from the trust.

Source of Income: The trustee is required to consider the beneficiary’s other sources of income when a disbursement is requested.

Monthly Budgets: Beneficiaries are encouraged to provide monthly budgets so that the Trustee can easily determine the appropriateness of the bequest. This helps to safeguard government benefits.

Trust Funds: Mis-use of the trust funds including misuse of a True Link card may result in a hold being placed on the beneficiary’s disbursements.

Policy: Inappropriate conduct by the beneficiary or anyone acting on his or her behalf will not be tolerated. This includes making disparaging remarks or harassing staff of Lagniappe Fiduciary Services or Miramon Law, Inc. Time and expenses incurred in responding to inappropriate behavior will be billed to the Trust.
